This Privacy Policy explains how Acid Test Inc., a Delaware corporation (“Acid Test,” “we,” “us,” or “our”), collects, uses, discloses, and protects information when you visit our website, use our products or services, communicate with us, or otherwise interact with Acid Test.

This Privacy Policy applies to our website, product, software, research tools, dashboards, applications, and related services that link to this Privacy Policy, together referred to as the “Services.”

If you use Acid Test on behalf of a company, organization, or other entity, that entity may have a separate agreement with us that also governs its use of the Services. If there is a conflict between this Privacy Policy and a signed agreement with a customer, the signed agreement will control to the extent of the conflict.

1. Information We Collect

We collect information in several ways.

Information you provide to us

We may collect information that you provide directly, including:

  • Company name
  • Job title or role
  • Account login information
  • Billing and subscription information
  • Messages, support requests, survey responses, and other communications
  • Waitlist, demo request, or contact form submissions
  • Product inputs, prompts, instructions, project names, research briefs, and other content you submit
  • Uploaded files or assets, such as ads, images, videos, PDFs, documents, brand materials, landing page screenshots, datasets, or other materials

Information collected through use of the Services

When you use the Services, we may collect information about your activity and device, including:

  • IP address

  • Operating system
  • Referring pages
  • Pages viewed
  • Features used
  • Session activity
  • Approximate location derived from IP address
  • Log data, error reports, and diagnostic information
  • Product events, such as projects created, files uploaded, outputs generated, settings changed, or reports viewed

Customer content

“Customer Content” means content submitted to the Services by or on behalf of a customer or user, including prompts, research inputs, uploaded assets, brand materials, project data, datasets, and generated outputs.

Customer Content may include personal information if you or your organization choose to include it. You are responsible for ensuring that you have the rights, permissions, and lawful basis needed to submit Customer Content to the Services.

Information from third parties

We may receive information from third parties, including:

  • Authentication providers
  • Payment processors
  • Analytics providers
  • Marketing tools
  • Business partners
  • Publicly available sources
  • Service providers used to operate or secure the Services

For example, if you pay for the Services through a payment processor, we may receive billing status, subscription status, transaction metadata, and limited payment-related information. We do not need to store full payment card numbers if payments are handled by a payment processor.

2. How We Use Information

  • Provide, operate, maintain, and improve the Services
  • Create and manage user accounts
  • Authenticate users and secure accounts
  • Process payments, subscriptions, invoices, and billing events
  • Respond to support requests, demo requests, and other communications

  • Process uploaded files and other Customer Content

  • Detect, prevent, and investigate fraud, abuse, security incidents, and misuse

3. AI and Model Providers

Acid Test may use artificial intelligence models, model providers, infrastructure providers, and related tools to provide parts of the Services. These providers may process prompts, Customer Content, uploaded files, metadata, or generated outputs as needed to deliver requested features.

We use these providers to perform tasks such as:

  • Generating or evaluating research outputs
  • Summarizing or analyzing uploaded materials
  • Extracting information from files
  • Scoring or interpreting creative assets
  • Producing recommendations, reports, or other requested outputs
  • Operating AI-assisted product features

We do not use Customer Content to train third-party foundation models unless you ask us to do so or give us permission.

We may review outputs, logs, and related usage data to improve reliability, quality, safety, and product performance.

4. Cookies and Similar Technologies

We may use cookies, pixels, local storage, and similar technologies to:

  • Keep users signed in
  • Remember preferences
  • Understand website traffic
  • Measure product usage
  • Improve performance
  • Support security and fraud prevention
  • Evaluate marketing effectiveness

Service providers

Customers and workspace members

If you use the Services as part of a company account, organization, workspace, or team, information associated with your account and activity may be visible to administrators or other authorized members of that workspace.

We may disclose information if we believe it is reasonably necessary to:

  • Enforce our terms, agreements, and policies
  • Protect the rights, property, or safety of Acid Test, users, customers, or others

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.

7. Data Retention

We retain information for as long as reasonably necessary to provide the Services, maintain our business records, comply with legal obligations, resolve disputes, enforce agreements, and protect the Services.

Retention periods may depend on the type of information and the context in which it was collected. For example:

  • Account information may be retained while your account is active
  • Customer Content may be retained while needed to provide the Services or as configured by the customer
  • Billing records may be retained as required for tax, accounting, and legal purposes
  • Security logs may be retained for fraud prevention, abuse detection, and system protection
  • Backups may be retained for a limited period before deletion through ordinary backup cycles

You may request deletion of certain information by contacting us, subject to legal, security, contractual, and technical limitations.

8. Security

We use reasonable administrative, technical, and organizational measures designed to protect information. These measures may include access controls, authentication, encryption in transit, logging, monitoring, and vendor review processes.

No method of transmission or storage is completely secure. We cannot guarantee absolute security.

You can unsubscribe from marketing emails by using the unsubscribe link in the email or contacting us. You may still receive transactional, administrative, billing, security, or service-related messages.

This section applies to California residents where applicable law requires.

11. International Users

Acid Test is based in the United States. If you access the Services from outside the United States, your information may be processed in the United States and other countries where our service providers operate.

These countries may have privacy laws that differ from those in your jurisdiction.

Where required, we use appropriate safeguards for international transfers of personal information.

12. Business Customers and Data Processing

For business customers, Acid Test may process Customer Content on behalf of the customer. In that context, the customer may be the controller or business responsible for determining the purposes and means of processing, and Acid Test may act as a processor or service provider.

If your information was submitted to the Services by or on behalf of an Acid Test customer, you may need to contact that customer directly to exercise privacy rights. We will support customers in responding to valid requests as required by applicable law and our agreements.

13. Sensitive Personal Information

The Services are not designed for processing sensitive personal information unless expressly agreed in writing.

You should not submit sensitive personal information, such as government identification numbers, financial account numbers, precise geolocation, health information, biometric data, children’s data, or other highly sensitive information, unless you have authority to do so and the submission is permitted under your agreement with us.

14. Children’s Privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13.

If we learn that we have collected personal information from a child under 13 without appropriate consent, we will take reasonable steps to delete it.

15. Third-Party Links and Services

The Services may link to third-party websites, applications, integrations, or services. We are not responsible for the privacy practices of third parties. Their privacy policies govern their own collection and use of information.
